Senate Democrats blocked a measure that would be included in their “Reducing Inflation Act,” which would have required President Joe Biden to retain Title 42 authority for the Centers for Disease Control and Prevention (CDC) at the U.S.-Mexico border.
In April, CDC officials announced that a Biden administration would end Section 42 powers at the southern border by May 23. The power, first implemented by former President Trump in March 2020, allows Border Patrol agents to quickly deport illegal aliens back to Mexico.
The following month, Judge Robert R. Summerhays, a Trump appointee, ordered Biden to keep Article 42 while the issue moved through federal court. However, the Biden administration continues to push to end Article 42.
Sen. James Lankford (R-OK) introduced amendments to the Democrats’ lower inflation bill passed Sunday required Biden will keep Article 42 to help reduce record levels of illegal immigration.
Although Sens. Kyrsten Sinema (D-AZ), Joe Manchin (D-WV), Jon Tester (D-MT), Gary Peters (D-MI), Maggie Hassan (D-NH), Raphael Warnock (D-GA) , Catherine Cortez Masto (D-NV), Mark Kelly (D-AZ) and Chris Coons (D-DE), who have previously claimed they oppose ending Section 42, voted against the amendment with all other Senate Democrats.
For months, the Biden administration has prematurely started phasing out Article 42.
Without Section 42, Biden officials have acknowledged that as many as half a million border-crossers and illegal aliens — equivalent to the resident population of Atlanta, Georgia — could reach the border each month.
Rep. Andy Biggs (R-AZ) told Breitbart News that he expects 30,000 border crossers and illegal aliens a day without Title 42. In April, Breitbart News exclusively reported that as many as 6,000 foreigners in Tijuana, Mexico were rushed to the border as they waited for Title 42 to end.
Biden administration plans to end Title 42, Breitbart News reports and postdetailing a “mass release mechanism” that would transform the border into simple checkpoints for foreigners arriving daily.
