Developers aren’t happy with indie games reportedly showing up on GameStop’s new NFT marketplace without proper licensing.

in a new Ars Technica reportNathan Ello allegedly created the NiFTy Arcade series with indie games like Worm Nom Nom, Galactic Wars, and Rogue Fleet, but at least two games (Worm Nom Nom and Galactic Wars).

Ello said he tried to include only open-source games approved for commercial use in his NFT collection, but he apparently didn’t do enough research. The Creative Commons license for Worm Nom Nom is listed in its pageits engine PICO-8 also requires the user to obtain the creator’s consent before any use takes place.

After facing resistance, Ello gave all NFT sales (totaling $55,000 as of July 15th) to the original developers and removed the NiFTy series from GameStop’s NFT marketplace. But developers say those actions came too little too late. “My work was sold for profit without my consent,” says Breakout Hero developer Kyrstian Majewski. “Even if someone wanted to refund the money they made from my job, it would come in the form of some bad cryptocurrency anyway.”

Ello can no longer mint coins on the GameStop NFT marketplace until the licensing issue is resolved, but one glaring problem remains: NiFTy games cannot be removed from the blockchain and can be sold on other marketplaces.

NFTs are often touted as being “beneficial” to artists and creatives, but there are countless instances where creators’ work has been minted without permission.There are a lot of stolen artworks uploaded to open seaand due to the sheer volume of thefts and the unresponsive platforms, it is difficult for artists to take them down.

Disturbingly, GameStop does not appear to have implemented a removal or screening service to catch cases of theft. The company did not respond to Ars Technica’s request for comment, so it remains to be seen how GameStop will prevent such cases from happening again in the future.
